Um die Kinderrechte in ihrer Bedeutung zu erfassen, soll zunächst ein Überblick zur Entstehung und zu den Artikeln der Kinderrechtskonvention erfolgen. Dabei wird der Fokus auf die Partizipationsartikel gerichtet, die Kindern unabhängig ihres Alters, das Recht auf Beteiligung einräumen (sollten). Anknüpfend daran, wird der common remark zur Umsetzung der Kinderrechte in der frühen Kindheit näher betrachtet. Im weiteren Verlauf sollen die gesetzlichen Grundlagen zum Thema „Bestimmung“ auf nationaler-, bzw. Landesebene betrachtet werden. In den von den Bundesländern konzipierten Bildungs- und Erziehungsplänen wird dem Kindergarten eine wesentliche Rolle bei der Umsetzung zugeschrieben. Aufgrund dessen soll im letzten Teil dieser Arbeit untersucht werden, inwieweit Kindertagesstätten mithilfe von Projekten und die Verankerung von Beteiligung in den pädagogischen Konzepten, zu einer tatsächlichen Partizipation von kleinen Kindern beitragen können.
